These Terms of Service constitute a legally binding agreement between you ("Customer," "you," or "your") and MRGNV Mold Removal Gainesville LLC ("MRGNV," "we," "our," or "us"), a limited liability company licensed to operate in the State of Florida as a mold remediator under Chapter 468, Part XVI of the Florida Statutes. By calling us, submitting a contact form, requesting a service visit, or signing a service authorization, you agree to these Terms and our Privacy Policy.
MRGNV provides licensed mold remediation services in Gainesville FL and Alachua County including black mold removal, attic mold removal, crawl space mold remediation, HVAC mold treatment, bathroom and kitchen mold removal, post-flood mold remediation, commercial mold remediation, insurance claims documentation, and post-remediation clearance coordination. All services are performed in accordance with Florida DBPR regulations, IICRC S520 Standard for Professional Mold Remediation, and EPA mold remediation guidelines.
MRGNV holds an active Florida DBPR Mold Remediator license under Chapter 468, Part XVI of the Florida Statutes. Florida law requires that any person performing mold remediation on areas greater than 10 square feet hold an active DBPR license. Florida law also prohibits the same licensee from performing both mold assessment and mold remediation on the same project. MRGNV performs remediation only. Post-remediation clearance testing is coordinated with a separate independent Florida licensed mold assessor as required by law. You can verify MRGNV's license status at myfloridalicense.com.
Before any remediation work begins at your property, you will be asked to review and sign a Service Authorization. By signing, you represent that you are the property owner or have legal authority to authorize work, you have the right to authorize insurance claim filing if you request us to do so, and all information you provide regarding your property and insurance coverage is accurate. Emergency stabilization may begin before a full written agreement with verbal authorization in situations requiring immediate action.
If paying directly without insurance, payment is due upon completion of each phase of work unless alternative terms are agreed in writing. We accept major credit cards, check, and bank transfer.
If you authorize MRGNV to bill your insurance carrier directly, we submit all documentation to your insurer. You remain responsible for any applicable deductible, amounts determined not covered, and amounts above policy limits.
Your insurance deductible is your financial responsibility and is not waived or discounted by MRGNV. Any arrangement purporting to waive an insurance deductible is improper under Florida law and is not offered by MRGNV.
Unpaid invoices more than 30 days past due may be subject to a monthly finance charge of 1.5% or the maximum permitted by Florida law. MRGNV reserves the right to pursue all available legal remedies including a contractor's lien on the property.
MRGNV assists with insurance claim documentation including moisture readings, mold species reports, photographic evidence, and DBPR compliant remediation reports. We do not guarantee that your claim will be approved. MRGNV is not a licensed public adjuster. We can recommend licensed Florida public adjusters if you need representation in a claim dispute.
By authorizing service, you grant MRGNV and its licensed technicians the right to access your Gainesville or Alachua County property during reasonable hours for the purpose of performing mold remediation. You agree to inform MRGNV of any known hazards including asbestos-containing materials, lead paint, electrical hazards, or structural instability prior to commencement of work. Gainesville homes built before 1978 may contain asbestos or lead paint materials that require separate testing and abatement protocols.
To the fullest extent permitted by Florida law, MRGNV's total liability shall not exceed the total amount paid for the specific services giving rise to the claim. MRGNV is not liable for pre-existing conditions, hidden defects, prior damage, or mold that develops after remediation is complete due to new moisture events or conditions outside our control. Gainesville's subtropical climate creates ongoing mold risk that only proper long-term moisture management can address.
MRGNV warrants that all mold remediation work will be performed in accordance with Florida DBPR regulations and IICRC S520 standards. We guarantee that remediation is not considered complete until independent post-remediation clearance testing confirms mold spore concentrations have returned to acceptable levels. Our one-year workmanship warranty covers defects in materials and labor but does not cover mold resulting from subsequent water events, new moisture sources, or ongoing humidity conditions not addressed in the original scope of work.
Disputes shall first be subject to good faith negotiation. If unresolved within 30 days of written notice, the parties agree to mediation administered by a mutually agreed mediator in Alachua County, Florida, with costs shared equally. If mediation is unsuccessful, any litigation shall be brought in the state or federal courts of Alachua County, Florida. You consent to the personal jurisdiction of those courts.
